Welcome to Braintech Finance
Braintech Finance is the Marketplace that allows Users to benefit from market analysis strategies specifically created by the Creators, who make use of Braintech’s technological services. Before registering and accessing Braintech, Users are required to carefully read these Terms & Conditions and the Privacy Policy.

ART. 1 - DEFINITIONS
The following terms, written with an initial capital letter – whether in the singular or plural – have the meanings indicated below and shall be interpreted as such within this Agreement:
MT4 Platform: the “MetaTrader 4” (MT4) software used for operating Expert Advisors (EAs). Through their MT4 Account, the User can perform trading and/or investment operations on financial markets.
BrainLink: the EA (Expert Advisor) provided by Braintech and available for download from the Platform, which the User must install on their VPS to allow the Strategies to operate continuously.
VPS: the virtual private server, offered by a Braintech Finance partner through a monthly subscription (with a 30-day free trial), required by the User to keep BrainLink operational 24/7.
MT4 Trading Account: the investment account linked to the User’s MT4 Account.
MT4 Account: the account that grants access to financial markets and enables investment operations through MT4 Credentials.
MT4 Credentials: the credentials that allow the User to operate on the MT4 Account.
Braintech: see Braintech Finance.
Braintech Finance: collectively:
The Service Provider identified in these Terms & Conditions;
The Platform produced and marketed by the Provider.
Broker Partner: entities, partners of the Provider, authorized to access financial markets according to the regulations in force in their respective countries of operation, with whom Users may register an MT4 Account, create an MT4 Account, and execute investment operations.
Creator: a partner of Braintech who designs the market analysis strategies made available on the Platform.
Ordinary Maintenance: all regularly scheduled activities carried out by Braintech Finance to maintain the functionality of the infrastructure resources through which the Service is provided.
Extraordinary Maintenance: all urgent activities carried out at the sole discretion of Braintech Finance to avoid risks to the security, stability, confidentiality, or integrity of the Service.
Platform: the software infrastructure created by Braintech Finance, within which market analysis Strategies are made available and can be used through the intermediation of Broker Partners in autonomous investment operations by the User, the results of which (e.g., account balance, closed trade reports) can be monitored (for clarity: “can be monitored in real time regarding the balance and reports of already completed trades”) within the Platform itself.
Service: the right and actual ability for Users to use Braintech Finance’s proprietary Platform.
Strategy: the set of rules, parameters, and market-analysis logic developed by Braintech Finance in collaboration with the Creators. Strategies are made available on the Platform and may be used by the User through the intermediation of a Broker Partner. Their use, configuration, and management remain the exclusive responsibility of the User.
Terms & Conditions: this document, consisting of 16 articles, which Users accept before registering on the Platform.
User: the individual who, after completing registration on the Platform, uses the Service provided by Braintech Finance.
ART. 2 - SCOPE OF APPLICATION AND COMPLETION OF THE TERMS & CONDITIONS
1. These Terms & Conditions apply to the Service provided by Braintech.
2. These Terms & Conditions take effect for the User upon acceptance during the registration process on the Platform.
ART. 3 - DESCRIPTION OF THE PLATFORM
1. The proprietary Platform of Braintech Finance is the Marketplace through which Strategies are made available to Users.
2. The User may autonomously use the Strategies available on the Platform through their investment accounts, without any involvement from Braintech.
3. Before performing any operation through the Strategies available on the Platform, the User undertakes to gather the necessary information in order to understand how they function.
4. The Strategies may be used by the User through the intermediation and/or investment advisory services provided by a Broker Partner, an intermediary authorized under the applicable regulations. Braintech will not be involved in such operations under any circumstances.
5. The Platform enables the User, if they have executed investment operations through a Broker Partner using the Strategies, to view their account balance and the reports of completed operations.
6. Each Strategy may be customized by the User within the technical and functional limits set by the Platform, including parameters such as risk per trade and capital allocation.
7. Braintech Finance currently offers the Platform without subscription fees or charges to the User. Braintech receives compensation from Broker Partners in the form of a share of the commissions generated from the User’s trading activity on accounts connected to the Platform.
8. The performance, execution frequency, and overall operation of the Strategies may vary depending on technological, liquidity, or policy constraints of the Broker Partner selected by the User. Braintech Finance, in collaboration with the Creators, continuously updates the algorithmic logic and related parameters to ensure compatibility with broker infrastructure, incorporate technological developments, and adapt to changes in financial markets.
ART. 4 - REQUEST FOR SERVICE ACTIVATION
1. The Client may request activation of Braintech’s Services by registering an account at https://app.braintechfinance.com/register and following the instructions contained in the registration email and/or in the “Profile” section of the Platform.
2. The User may register according to the procedures described in Article 5 below.
ART. 5 - REGISTRATION AND ACTIVATION OF THE SERVICE
1. After registration, the Client will receive an email containing the License Key to enter into their BrainLink. Subsequently, they must activate BrainLink to manage the Strategies available on the Platform, which will operate on the financial markets through their MT4 Account.
2. To use Braintech’s Services, the User requires an MT4 Account that remains continuously active. For this purpose, the Client must have access to their own server ensuring uninterrupted connection to the MT4 Account via the internet, or alternatively, they must equip themselves with a VPS. Braintech provides Clients with guidance and support for installing the MT4 platform on their server.
3. Once the above operations have been completed and Braintech Finance has verified the successful completion of the registration process, the Client’s profile on the Platform will move to “active” status. The Client may then, through their investment account and with the intermediation and/or advisory services of a Broker Partner, autonomously from Braintech Finance, use the Strategies available on the Platform.
ART. 6 - SUPPORT AND ASSISTANCE
1. Braintech provides the Client with support and assistance services for all operations necessary for activating the Service, including, by way of example: VPS purchase and installation, installation of the MT4 Account on the Client’s server, and guidance in using the MT4 Account.
2. These assistance activities will be activated upon the Client’s request by contacting the Braintech team.
3. These activities will be carried out in the manner agreed upon from time to time between the Client and Braintech.
4. The User is responsible for maintaining the confidentiality of their password and undertakes not to disclose it to third parties. In case of loss or suspected unauthorized access, the User must immediately request a password reset through one of the following channels:
via the “Forgot Password” function on the login page;
via the “Change Password” function in the “Settings” section of the Platform;
by contacting support at support@braintechfinance.com using the same email address used for account registration.
ART. 7 - BROKER PARTNERS
1. Broker Partners are entities that use the Braintech Finance Platform and qualify as “financial intermediaries,” holding licenses or authorizations issued by public authorities or financial regulatory bodies, and authorized to operate in financial markets.
2. Broker Partners are independent and separate entities from Braintech Finance, which is under no circumstances to be considered a financial intermediary.
3. The intermediation of Broker Partners is instrumental and necessary for executing investment operations.
4. The Client who, during registration on the Platform, registers an MT4 Account with a Broker Partner, is required to accept the Broker Partner’s Terms & Conditions. Under no circumstances shall Braintech Finance be considered responsible for rights and obligations arising from a Broker Partner’s Terms & Conditions.
ART. 8 – DURATION AND TERMINATION
1. This contractual relationship has an indefinite duration, as the use of the Service offered by Braintech Finance is free and without any subscription fees.
2. The User may terminate use of the Platform and request deletion of their account at any time by sending an email to support@braintechfinance.com with the subject “Account Deletion Request,” including their name, surname, date of birth, and telephone number provided during registration. If the account is in “Active” status, the User must also provide their MT4 Account number and BrainLink license key.
3. From the moment of the account deletion request, Braintech Finance undertakes to cease all processing of the User’s personal data, except where necessary to comply with legal obligations (e.g., retention of accounting or tax data, where applicable).
4. Braintech Finance reserves the right to suspend or close a User’s account if they violate these Terms & Conditions or commit unlawful acts, without notice and without any obligation of indemnification or compensation.
ART. 9 - USER OBLIGATIONS
1. The User undertakes to use the Service in good faith and to cooperate with Braintech to allow the execution of all activities necessary for the provision of the Service.
2. The User also undertakes not to alter the Platform or BrainLink in any way, including through decompilation, disassembly, reverse engineering, system violations, or improper use of the product, making all reasonable efforts to maintain the Platform’s functionality.
3. The User shall not use the Service for unlawful or fraudulent purposes and must ensure that adequate measures are in place to prevent third parties from engaging in such conduct, whether involving the User’s equipment or otherwise.
4. The User undertakes to inform themselves about the functioning of the Strategies available on the Platform before performing any operations with them.
5. The User declares to be over eighteen years of age, the minimum age required to use the Platform.
ART. 10 - DISCLAIMER
The User declares to have read, understood, and accepted the official Disclaimer, which forms an integral and substantial part of these Terms & Conditions and is available at the following link: disclaimer
ART. 11 - LIABILITY AND INDEMNITY
1. The use of information provided through the Platform for personal investment decisions is entirely at the User’s own risk. Braintech Finance is not responsible for any losses or damages resulting from decisions made based on such information and declines all responsibility for the use of Expert Advisors (EAs) and any losses or damages arising from their use. The User acknowledges being fully aware of the risk of losing money associated with online trading operations and assumes full responsibility for the consequences of such operations, which they have freely chosen to undertake.
2. The Client is responsible for reporting profits and earnings obtained through investment operations to the competent authorities in accordance with applicable tax legislation, indemnifying and undertaking to hold Braintech Finance harmless from any claims by tax collection bodies.
3. Braintech shall not be liable under any circumstances for investment operations independently carried out by the User on their MT4 Account or MT4 Trading Account.
4. Braintech Finance is not responsible for content found on third-party websites linked via hyperlinks. The User assumes full responsibility for any losses or damages resulting from access to such websites.
5. Braintech shall not be liable to the User for any direct, indirect, incidental, special, punitive, or consequential damages resulting from any of the following circumstances:
a. Ordinary or Extraordinary Maintenance activities;
b. incorrect use, incorrect configuration, or commands voluntarily or involuntarily executed by the User;
c. anomalies or malfunctions of software or applications provided by third parties and used by the User;
d. failure to comply with or violation of these Terms & Conditions by the User;
e. events resulting from third-party providers involved in activities covered by these Terms & Conditions;
f. actions carried out outside of Braintech’s control;
g. errors, inaccuracies, or imprecision in products or services;
h. any property or non-property damages arising from access to or use of Braintech’s products or services;
i. unauthorized access or use of Braintech’s servers and/or theft of stored personal information;
j. internet network issues, hardware or software malfunctions, cyberattacks (including viruses or hacking), or other external circumstances;
k. temporary interruption of product or service provision;
l. bugs, viruses, trojans, malware, or similar software transmitted through third-party products or services.
6. More generally, the User may not hold Braintech liable for contractual or non-contractual liability (including negligence), direct or indirect, arising from indemnity obligations, violations of legal obligations, or otherwise connected to these Terms & Conditions regarding: product loss, loss of revenue, loss of earning potential, loss of business opportunities, reputational damage, loss or compromise of data, or any indirect or consequential damages.
7. Braintech Finance and the Creators assume no responsibility for:
a . any financial losses suffered by the User as a result of trading operations;
b. technical malfunctions, calculation errors, or discrepancies between operational results and the User’s expectations.
ART. 12 - SYSTEM MAINTENANCE
1. Braintech undertakes to perform evolutionary maintenance of the Platform, making updated versions available to the User during the validity of these Terms & Conditions, based on service compatibility.
2. Braintech may carry out Ordinary Maintenance at its sole discretion, informing Users of the scheduled activity and its duration at least 3 days before the intervention.
3. Extraordinary Maintenance needs will be communicated to Users as quickly as possible, taking into account the urgency in resolving related issues.
ART. 13 - PERSONAL DATA
1. Braintech undertakes to process personal data acquired in the execution of these Terms & Conditions in compliance with EU Regulation No. 679/2016 (GDPR).
2. The User’s personal data will be processed in accordance with the privacy policy available at: https://braintechfinance.com/privacy .
ART. 14 - INTELLECTUAL PROPERTY AND LIABILITY LIMITATIONS
1. The Platform and all its contents, including data, news, information, images, and graphics, are owned by Braintech Finance and third parties. It is prohibited to record, reproduce, copy, publish, or use these contents for commercial purposes without written authorization from Braintech Finance.
2. In particular, the Strategies referred to in Article 3, paragraph 2, are granted to the User under a non-exclusive license, limited to what is provided in these Terms & Conditions.
3. The execution of these Terms & Conditions does not entail, nor may it entail, any transfer, license, or implied consent to use beyond what is expressly stated.
ART. 15 - CHANGES TO THE TERMS & CONDITIONS
Braintech Finance reserves the right to modify these Terms & Conditions and/or suspend or update the Service at any time, without notice. Revisions will be published at: https://braintechfinance.com/terms&conditions. Continued use of the Services by the User constitutes acceptance of such modifications.
ART. 16 - FINAL PROVISIONS
1. If one or more clauses are declared void or rendered inapplicable by law or by a binding decision, this will not cause the nullity of these Terms & Conditions as a whole, nor alter the validity and binding nature of the remaining clauses.
2. These Terms & Conditions, as well as any dispute or claim arising from or related to them, are governed and interpreted in accordance with Italian law.
3. The Parties undertake to attempt any out-of-court solution to resolve disputes arising from these Terms & Conditions.
4. If such attempts prove unsuccessful, jurisdiction shall lie - unless otherwise required by mandatory laws - with the Court of Milan.
